1. About Cima

Cima is an educational preparation platform designed to help students prepare for academic examinations and university applications.

Depending on the Services offered, Cima may provide preparation materials and tools relating to:

• SAT
• Advanced Placement (AP)
• International Baccalaureate (IB)
• IGCSE
• University admissions
• Other academic examinations and educational programs

Cima may provide:

• Lessons and courses
• Practice questions
• Practice examinations
• Diagnostic assessments
• Personalized learning paths
• Progress tracking
• Study recommendations
• XP, levels, streaks, and achievements
• Leaderboards and leagues
• Parent progress tools
• Educational reports
• One-on-one tutoring
• Academic coaching
• University preparation resources
• Notifications and study reminders

We may add, modify, suspend, or discontinue features from time to time.

2. Educational Disclaimer

Cima is an educational preparation and practice service.

Cima does not guarantee:

• A particular examination score
• A particular grade
• A particular amount of score improvement
• Admission to a particular university
• Admission to any university
• Scholarship eligibility
• Acceptance into any academic program

Cima's practice scores, diagnostic results, recommendations, progress measurements, and other assessments are educational tools and should not be considered official examination results.

Cima is not affiliated with, endorsed by, or sponsored by the College Board, International Baccalaureate Organization, Cambridge University Press & Assessment, or any university unless expressly stated.

SAT, AP, IB, IGCSE, and related names and trademarks belong to their respective owners.

3. Eligibility and Accounts

You must provide accurate and current information when creating an account.

You may not:

• Create an account using false information
• Impersonate another person
• Access another person's account
• Share your account with another person
• Sell, transfer, or resell your account
• Circumvent applicable age or parental-consent requirements

If a parent or legal guardian creates or manages an account for a student, that parent or guardian is responsible for providing accurate information and supervising the student's use of the Services where appropriate.

You are responsible for maintaining the security of your account credentials and for activity occurring through your account.

4. Students and Minors

Cima may be used by students under the age of 18.

Where applicable law requires parental or guardian consent, Cima may require such consent before allowing certain users to create an account or before collecting certain personal information.

Cima may use different account and consent procedures depending on a user's age and applicable law.

Parents and legal guardians may have rights concerning a child's account and personal information as described in our Privacy Policy.

5. Parent and Guardian Accounts

Cima may provide parent or guardian accounts that connect to a student's account.

A parent or guardian who connects to a student's account represents that they have the legal authority to do so.

Depending on the features available, parents or guardians may be able to view information such as:

• Lesson completion
• XP
• Streaks
• Study activity
• Practice performance
• Study time
• Learning goals
• Progress

Cima may change or expand parent features as the Services develop.

6. Educational Content

Cima provides educational materials that may include:

• Practice questions
• Answer choices
• Explanations
• Lessons
• Exercises
• Practice examinations
• Study guides
• Examples
• Graphics
• Curriculum structures
• Databases
• Other educational materials

Cima owns or licenses its proprietary educational content.

Unless otherwise authorized by Cima, you may use Cima's educational content only for your personal educational purposes.

You may not:

• Copy or reproduce Cima's question bank
• Scrape the Services
• Extract Cima's educational database
• Reproduce Cima's curriculum commercially
• Sell Cima content
• Redistribute Cima content
• Upload Cima content to another platform
• Use automated systems to extract Cima content
• Build a competing database or service using Cima's proprietary content

7. Artificial Intelligence and Educational Content

Cima may use artificial intelligence ("AI") tools during the development, preparation, organization, or review of certain educational content.

AI-assisted content may include:

• Practice questions
• Answer choices
• Explanations
• Examples
• Exercises
• Study materials
• Other instructional content

AI-generated or AI-assisted content may be reviewed, edited, tested, and curated by Cima before being made available to users.

Because AI-assisted content may contain errors, Cima does not guarantee that every question, answer, explanation, or educational recommendation is completely error-free.

Cima does not represent AI-assisted content as official examination material.

Cima's use of AI to create or assist with educational content does not mean that Cima uses generative AI as a substitute for teachers, tutors, or qualified educational professionals.

Cima may modify its use of AI technologies as the Services develop. If our use of AI materially changes how user personal information is processed, we will update our Privacy Policy and provide additional notices or obtain consent where required by applicable law.

8. User Content

Certain Cima features may allow users to submit content, including:

• Written answers
• Essays
• Notes
• Profile photographs
• Feedback
• Messages
• Other educational materials

You retain ownership of content that you submit to Cima.

By submitting content, you grant Cima a limited, non-exclusive license to host, store, reproduce, process, and display that content solely as necessary to provide, maintain, secure, and improve the Services.

You represent that you have the rights necessary to submit the content.

9. Academic Integrity

Cima is designed to help students learn and prepare for examinations.

You may not use Cima to:

• Cheat on an examination
• Obtain unauthorized examination materials
• Share confidential examination questions
• Circumvent examination security
• Manipulate official examination systems
• Misrepresent Cima practice results as official examination results
• Facilitate academic misconduct

We may suspend or terminate accounts involved in serious abuse of the platform.

10. XP, Levels, Streaks, Crowns, and Leaderboards

Cima may include gamification features such as:

• XP
• Levels
• Streaks
• Crowns
• Achievements
• Leagues
• Leaderboards
• Daily goals

These features are intended to encourage consistent learning.

Cima may modify the rules, thresholds, scoring systems, rankings, or other mechanics associated with these features.

Virtual XP, crowns, achievements, levels, and rankings have no monetary value and cannot be exchanged for money.

11. Leaderboards

If you participate in a Cima leaderboard, other users may be able to see limited information such as:

• Display name
• Username
• Avatar
• XP
• Rank
• League

Users should avoid including their full legal name or sensitive personal information in public profile fields.

Cima may remove or modify usernames, avatars, or other public profile content that violates these Terms.

12. Subscriptions and Payments

Certain Cima features may require a paid subscription or other payment.

Before purchasing a paid Service, Cima will provide the applicable pricing and billing information.

Subscriptions may automatically renew unless canceled before the next billing period.

Payments are processed by Stripe or another payment provider identified during checkout.

Stripe may independently process payment information according to its own terms and privacy policies.

13. Cancellation

You may cancel a subscription through the cancellation mechanism made available by Cima or through the applicable payment platform.

Unless applicable law requires otherwise, cancellation will normally take effect at the end of the current billing period.

14. Refunds

Refunds are subject to Cima's applicable refund policy and any mandatory consumer rights under applicable law.

Nothing in these Terms limits any refund or cancellation rights that cannot legally be waived.

15. Tutoring and Academic Coaching

Cima may offer optional one-on-one tutoring or academic coaching.

Tutoring may be purchased separately from a Cima subscription.

Tutors provide educational assistance and do not guarantee a particular examination score, grade, university admission, or other academic result.

Additional terms may apply to tutoring services.

16. University Preparation

Cima may provide university preparation resources, including:

• University research
• Application planning
• Application checklists
• Application timelines
• Essay preparation
• Interview preparation
• Deadline tracking

These resources are informational and educational.

Cima does not guarantee admission to any university, scholarship, or academic program.

17. Third-Party Services

Cima relies on third-party providers to operate portions of the Services.

These may include:

• Stripe for payments
• Supabase for database, authentication, and application infrastructure
• Cloudflare for networking, security, performance, and related infrastructure
• Email providers
• Authentication providers
• Analytics providers
• Other technology and service providers

Third-party providers may have their own terms and privacy policies.

18. Prohibited Conduct

You may not:

• Reverse engineer Cima
• Attempt unauthorized access to Cima systems
• Scrape Cima
• Circumvent security measures
• Introduce malicious software
• Abuse Cima APIs
• Manipulate leaderboards
• Create fraudulent accounts
• Resell Cima access without authorization
• Copy proprietary educational content
• Interfere with the operation of Cima
• Use Cima for unlawful purposes

19. Intellectual Property

The Cima name, logo, branding, software, interface, educational materials, curriculum, question bank, databases, designs, and other proprietary materials are owned by or licensed to Cima.

These Terms do not transfer ownership of Cima's intellectual property to you.

20. Service Availability

We strive to keep Cima available and reliable but do not guarantee uninterrupted availability.

The Services may temporarily become unavailable because of:

• Maintenance
• Updates
• Technical problems
• Security incidents
• Third-party outages
• Events beyond our reasonable control

21. Account Suspension or Termination

We may suspend or terminate an account when reasonably necessary because of:

• Material violation of these Terms
• Fraud
• Abuse
• Security threats
• Unauthorized access
• Serious misuse of educational content
• Academic misconduct

Where appropriate and legally required, we will provide notice and an opportunity to resolve the issue.

22. Disclaimer of Warranties

To the maximum extent permitted by applicable law, the Services are provided on an "as is" and "as available" basis.

We do not guarantee that:

• Cima will always be available
• The Services will always be error-free
• Every educational question will be error-free
• Every explanation will be error-free
• Recommendations will always be appropriate
• Cima will produce a particular academic result

23. Limitation of Liability

To the maximum extent permitted by applicable law, Cima and Alan Dominguez will not be liable for indirect, incidental, consequential, special, or punitive damages arising from or related to your use of the Services.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

24. Changes to the Terms

We may update these Terms as Cima develops.

If we make material changes, we will provide reasonable notice.

Your continued use of Cima after the effective date of revised Terms constitutes acceptance of the revised Terms to the extent permitted by applicable law.

25. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where applicable law requires otherwise.
